I'd be shocked to find a court ruling that a company's navigation tool on its own site is a form of advertising. You missed "who's right" from that description! They wrote the contract and you get to prove that your definition of "advertising" should be used instead of their definition in their contract. Yahoo! says it's their own links, not advertising That often occurs when 2 parties to a contract disagree on what the terms mean. Has it really come to the point where Yahoo has sunk so low as to make its member sue them to fulfill their contractual promises? I certainly hope not! Until then, Yahoo! is allowed to leave it there.
